Excel Aviation - Drone Services Terms and Conditions

These Terms and Conditions (“Agreement”) govern the provision of drone services by Excel Aviation (“Provider,” “we,” “us,” or “our”) to our clients (“Client,” “you,” or “your”). By booking or using our services, you agree to the following terms and conditions.
1. Services Provided
Excel Aviation offers a wide range of drone-related services, including but not limited to:
- Aerial photography and videography
- Aerial surveys and mapping
- Inspection services (e.g., infrastructure, buildings, power lines)
- Event coverage (e.g., weddings, corporate events)
- Custom drone services tailored to specific client needs.
Our drones are operated by fully licensed and qualified pilots who comply with all relevant Civil Aviation Authority (CAA) regulations.
2. Booking and Payment
- Booking: To book our drone services, Clients must contact us through our website, by phone, or email. A booking is considered confirmed only upon receipt of a deposit (if applicable) or full payment.
- Payment: All payments for services must be received before or on the day the service is provided. Payments can be made via bank transfer, credit card, PayPal, or other methods agreed upon by both parties.
- Cancellation Policy: If you need to cancel a booking, the following terms apply:
- Cancellation within 48 hours of the service will incur a cancellation fee of 50% of the total service fee.
- Cancellations made within 24 hours of the scheduled service will result in the full fee being charged.
3. Client Responsibilities
- Access and Permissions: The Client is responsible for providing us with necessary access to the location where the drone services will be provided. This is due to obtaining any required permits or permissions for drone flights in restricted or controlled airspace.
- Safety and Cooperation: The Client agrees to cooperate fully with our drone operators and follow all safety instructions during the service. If the flight area is deemed unsafe by our team due to environmental or operational risks (e.g., weather, obstacles), services may be delayed or rescheduled.
- Weather Conditions: Drone services may be postponed or rescheduled in the event of poor weather conditions (e.g., strong winds, rain, fog). The safety of our team and equipment is our priority.
4. Drone Operations and Compliance
- Licensing: All drone pilots employed by Excel Aviation hold the necessary certifications from the Civil Aviation Authority (CAA) to operate drones commercially in compliance with UK regulations.
- Flight Restrictions: We operate drones strictly within the parameters set out by the CAA, including flight altitude limits, no-fly zones, and airspace restrictions. We reserve the right to refuse or halt service if the flight area does not meet these regulatory requirements.
- Insurance: Excel Aviation holds comprehensive insurance coverage, including public liability insurance, to cover any incidents or accidents during the operation of our drones. The Client is responsible for any additional insurance they deem necessary (e.g., for property or personal injury).
5. Data Protection and Privacy
- Footage and Data Usage: By using our services, the Client grants us permission to use any footage or data collected during the drone operations for promotional or marketing purposes, unless otherwise agreed in writing. If the Client wishes to keep footage private, we will respect such requests.
- Data Security: Excel Aviation will take all necessary measures to ensure the safety and security of any data or footage collected. We will not share any personal or sensitive data without explicit consent, unless required by law.
- Retention of Data: Any media or data collected during the service will be retained for a period of 12 months, after which it will be deleted unless the Client requests otherwise in writing.
6. Limitations of Liability
- Damage to Property: While Excel Aviation takes all reasonable precautions to avoid any damage during drone operations, the Client acknowledges that drone operations carry inherent risks. We will not be held liable for any damage caused to property or persons except in cases of negligence or wilful misconduct by our team.
- Indemnification: The Client agrees to indemnify and hold harmless Excel Aviation, its employees, contractors, agents, and subcontractors from any claims, damages, losses, or expenses arising from the use of our services, except in cases of gross negligence or wilful misconduct by Excel Aviation.
7. Intellectual Property
- Ownership of Content: All aerial images, videos, and other content captured by our drones remain the property of Excel Aviation unless otherwise specified in the service agreement. The Client is granted a non-exclusive, non-transferable license to use the content for personal or business purposes, as agreed upon.
- Copyright: The Client is prohibited from using any media created by us for commercial purposes without prior written consent. When using the media publicly, appropriate credit must be given to Excel Aviation where applicable.
8. Force Majeure
Excel Aviation is not liable for any delay or failure in service due to events beyond our reasonable control, including but not limited to acts of God, severe weather, government restrictions, strikes, or other unforeseen circumstances that may prevent the operation of drones.
9. Amendments
Excel Aviation reserves the right to amend or update these Terms and Conditions at any time. Any changes will be posted on our website and will apply to all future bookings made after the date of such updates.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By booking or using our services, the Client acknowledges and agrees to these Terms and Conditions.
